Presidential Decree No. 138 of May 16, 2023 came into force, which regulates the rental and free use of property. This decree adjusts the procedure for using state-owned property and the property of business companies in which more than 50 percent of shares (shares in authorized capital) belong to the state, and also establishes a new procedure for determining the amount of rent.

In particular, this document provides for the possibility of leasing retail space to domestic manufacturers without holding auctions and using an increasing factor. The decree also delegated powers to approve the list of entities to which real estate is provided for free use, and clarified the list of legal entities receiving benefits for reimbursement of expenses associated with the maintenance and operation of real estate.

Taking into account the adoption of this decree, resolutions of the Council of Ministers were adopted: dated October 24, 2023 No. 726 “On the establishment of additional reducing factors to the base rent rate” and dated November 17, 2023 No. 787 “On measures to implement the Decree of the President of the Republic of Belarus dated 16 May 2023 No. 138." These resolutions define a list of government bodies, organizations, legal entities and individual entrepreneurs to whom real estate is provided for free use.

In addition, the document approved the Regulations on the procedure for transferring state-owned real estate for free use, and introduced additional increasing coefficients. In connection with these legal acts, some previously adopted resolutions and orders were declared invalid.
