In order to implement Presidential Decree No. 93 of March 14, 2022, aimed at strengthening the economy, the Government adopted Resolution No. 27, approving the regulations on the conditions and procedure for issuing permits for:

- sale of shares in authorized funds (shares) by foreign citizens;
- alienation of real estate by owners who are also foreign citizens;
- alienation of real estate by legal entities in whose authorized capital the share of ownership of foreign citizens is 25% or more;
- reorganization of legal entities, as well as their withdrawal from the list of owners, who are also foreign citizens.

In accordance with the established procedure, interested parties are required to contact the regional or Minsk city executive committees at the place of registration of the legal entity with a corresponding application and provision of the documents specified in the regulations, according to the list. After studying the submitted materials, the committee makes a decision on the possibility of carrying out these actions by a legal entity or individual, or on refusal of them. This decision also establishes the amount of the contribution that must be transferred to the budget and the timing of its payment.

Every month (if necessary), based on the decisions of the executive committees, the State Property Committee prepares a consolidated draft resolution of the Council of Ministers of the Republic of Belarus on the issuance of relevant permits.

It should be noted that the refund of the paid contribution is provided only in the event of failure to complete a transaction for the alienation of real estate by legal entities in which the share of ownership of foreign citizens is 25% or more.

The resolution comes into force after its official publication.
